Edgecase Labs LLC ("we," "our," or "us") operates the Açai - Nutrition Tracker application and other mobile applications (collectively, the "Apps"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Apps. Please read this policy carefully. By using our Apps, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

• Health & Fitness Data: Health-related information you voluntarily enter, such as weight, height, age, gender, activity level, and dietary goals.
• Food Images & Text Queries: Photos of food and text descriptions you submit for nutritional analysis.
• User Content: Emails, text messages, or other communications you send to us for customer support purposes.
• Sensitive Information: Certain health-related data you provide for app functionality and personalized recommendations.

1.2 Information Collected Automatically

• Device ID: A unique identifier for your device, used for analytics and product personalization.
• Usage Data & Product Interaction: Information about how you use the App, including features accessed, session duration, and interaction patterns.
• Coarse Location: Approximate location data used for product personalization and analytics (not precise GPS coordinates).
• Crash Data & Diagnostics: Technical data about app crashes and performance, used to improve app stability.

• Personalize your experience based on your health profile and dietary goals.
• Send technical notices, updates, security alerts, and support messages.
• Respond to your comments, questions, and customer support requests.
• Analyze usage patterns and trends to improve user experience and app performance.
• Detect, investigate, and prevent fraudulent or unauthorized activity.

3. AI-Powered Data Processing & Third-Party AI Services

Important: Our Apps use AI technology to analyze food images and text queries for nutritional information. This section explains exactly what data is sent, to whom, and how it is protected.

3.1 What Data Is Sent to AI Services

When you use the food analysis features of our Apps, the following data may be transmitted to our AI processing service:

• Food images that you capture or upload for nutritional analysis.
• Text queries you enter describing food items or meals.
• Contextual health profile data (such as dietary goals and restrictions) necessary to provide personalized nutritional analysis.

3.2 Who the Data Is Sent To

Our Apps use two AI systems to provide nutritional analysis:

• Edgecase Labs Proprietary Model: Text queries and nutritional calculations are processed by our own proprietary AI model, hosted on secure cloud infrastructure managed by Edgecase Labs. This model handles food identification from text descriptions, nutritional data retrieval, and personalized dietary analysis.
• Google Gemini API (Visual Analysis): When you submit a food image for analysis, the image is transmitted to Google's Gemini API for visual food recognition. Google processes this image data on our behalf solely for the purpose of identifying food items in the photograph. Google's privacy policy is available at policies.google.com/privacy. Google's Gemini API terms prohibit the use of your data to train Google's general AI models when accessed through the API.

Your data is transmitted to these services solely for the purpose of providing real-time nutritional analysis within the App. No other third-party AI services receive your personal data.

3.3 User Consent

Before any personal data is sent to our AI processing service for the first time, the App will request your explicit permission. You may choose to:

• Grant permission to allow AI-powered food analysis, enabling the App to transmit food images and text queries for processing.
• Deny permission and use the App without AI-powered food analysis features.
• Revoke permission at any time through the App's settings.

3.4 Data Retention by AI Services

Food images and text queries sent for AI analysis are processed in real-time and are not stored on AI service servers after processing is complete:

• Edgecase Labs Model: Text queries are processed in real-time and are not persisted after the response is generated.
• Google Gemini API: Food images are sent for visual recognition only and are not retained by Google after processing. Per Google's API Data Usage Policy, data submitted through the Gemini API is not used to train Google's general AI models.

We do not retain copies of your food images on our servers unless you explicitly choose to save them within the App. No AI model — whether ours or Google's — is trained on your personal data.

3.5 Data Protection

All data transmitted to AI services is encrypted in transit using TLS 1.2 or higher. Google, as our third-party AI service provider, is contractually obligated through its API Terms of Service to provide the same or equal level of data protection as described in this Privacy Policy and is prohibited from using your data for any purpose other than providing the requested analysis. Our own proprietary model operates under the same data protection standards outlined in this policy.

4. Nutritional Calculations & Medical Information Sources

Our nutritional calculations and health metrics are based on the following established, peer-reviewed scientific sources and databases:

4.1 Calorie & Nutritional Data

USDA FoodData Central (fdc.nal.usda.gov) — The primary source for food composition data, maintained by the U.S. Department of Agriculture. Provides comprehensive nutrient profiles for thousands of foods.

4.2 Total Daily Energy Expenditure (TDEE)

4.5 AI-Assisted Analysis

Our AI model assists in identifying food items from images and estimating portion sizes. These estimates are approximations and may vary from actual nutritional content. For precise dietary management, we recommend verifying nutritional information with a registered dietitian or using laboratory-tested food composition data.

5. Data Sharing & Third Parties

We do not sell your personal information. We may share your data only in the following circumstances:

5.1 Service Providers

We engage trusted third-party service providers to help us operate the Apps, including cloud hosting, analytics, and AI processing. These providers are contractually required to protect your data and use it only for the services they provide to us. Each third-party provider maintains privacy practices that offer the same or equal level of protection as this Privacy Policy.

5.2 Legal Requirements

We may disclose your information if required to do so by law, in response to valid legal requests by public authorities (e.g., a court or government agency), or to protect the rights, property, or safety of Edgecase Labs, our users, or the public.

5.3 Business Transfers

In the event of a merger, acquisition, or asset sale, your personal data may be transferred. We will provide notice before your personal data becomes subject to a different privacy policy.

Nutrition data you save within the App is stored securely and can be deleted at any time through the App's settings. Food images processed by our AI system are used solely for real-time nutritional analysis and are not stored on our servers after processing.

8. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

• Access: Request a copy of the personal information we hold about you.
• Correction: Request correction of inaccurate personal information.
• Deletion: Request deletion of your personal information.
• Data Portability: Request a copy of your data in a portable format.
• Opt-Out: Opt out of certain data processing activities, including AI-powered food analysis.
• Withdraw Consent: Withdraw consent for AI data processing at any time through the App's settings without affecting the lawfulness of prior processing.

9. Children's Privacy

Our Apps are not intended for children under 13 years of age (or under 16 in the European Economic Area). We do not knowingly collect personal information from children under these ages. 10. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have different data protection laws. We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy within the App and updating the "Last updated" date at the top. Your continued use of the Apps after changes are posted constitutes acceptance of the revised policy.
